1. Purpose
These terms of use ("Terms") set out the conditions under which Djavrok ("the Publisher") makes the Code de la route mobile application ("the App") available, and the conditions under which the user ("the User") may use it.
2. Acceptance
Downloading, installing or using the App constitutes full acceptance of these Terms by the User. If the User does not accept these Terms, they must not install or use the App.
3. Nature of the App — training tool only
The User expressly acknowledges and accepts that the App is exclusively a personal training tool intended to help review the French driving theory test material. The App:
- Does not replace training provided by a driving school or an approved driving instructor;
- Does not replace the official driving theory test administered by the State or any approved operator;
- Is not affiliated with any official examination body or public administration;
- Does not guarantee success at the official exam in any way, regardless of the results obtained within the App.
The questions, answer explanations and statistics offered are for educational purposes and aim to reflect the format and spirit of the official exam, without any guarantee of completeness, perfect timeliness, or full conformity with the question bank actually used on exam day, which is determined by the competent authorities and may change independently of the App.
4. License to use
The Publisher grants the User a personal, non-exclusive, non-assignable and non-transferable license to use the App, worldwide, for the duration of the intellectual property rights attached to the App. This license is limited to strictly personal, non-commercial use, on devices controlled by the User.
5. Permitted and prohibited use
The User agrees to use the App as intended. In particular, it is prohibited to:
- Decompile, disassemble or attempt to extract the App's source code, except where permitted by law;
- Modify, adapt or create derivative works from the App or its question bank;
- Circumvent or attempt to circumvent the App's technical protection measures;
- Reproduce or publicly distribute the App's educational content for commercial purposes;
- Assign, sublease, lend or sublicense the App to a third party.
6. Intellectual property
The App, its structure, question bank, answer explanations, graphic and textual elements, as well as related trademarks and logos, are the exclusive property of the Publisher or its content providers and are protected by intellectual property law. This license does not transfer any intellectual property right to the User.
8. Service availability and changes
The Publisher strives to keep the App accessible and to regularly update its question bank, but does not guarantee continuous, uninterrupted availability, nor the permanent completeness of the content with respect to regulatory changes. The Publisher reserves the right to change, modify or suspend all or part of the App at any time, without this giving rise to any compensation for the User.
9. Warranties and limitation of liability
The App is provided "as is". To the extent permitted by applicable law, the Publisher disclaims any implied warranty of fitness for a particular purpose, error-free operation, or any outcome regarding success at the driving theory test.
The Publisher shall not be liable for failing the official exam, for damage resulting from improper use of the App, force majeure, device failure, the User's internet connection, or the act of a third party. Nothing in these Terms excludes or limits the Publisher's liability for fault or negligence where such exclusion would be prohibited by applicable law.
10. Termination
The User may stop using the App and uninstall it at any time. The Publisher may suspend or terminate a User's access to the App in the event of a serious breach of these Terms, without prejudice to any other remedy.
11. Governing law and jurisdiction
These Terms are governed by French law. In the event of a dispute, and failing an amicable resolution, the competent French courts shall have jurisdiction, subject to any mandatory consumer-protection rules applicable at the User's place of residence where the User is a consumer.
12. Consumer mediation
In accordance with Articles L. 616-1 and R. 616-1 of the French Consumer Code, any consumer has the right to use a consumer mediator free of charge to seek an amicable resolution of a dispute with the Publisher. 13. Changes to these Terms and contact
The Publisher may amend these Terms at any time. The applicable version is the one in force at the time of use of the App, with the last update date shown at the top of this page. For any question: contact@djavrok.com.
